David also … we all know what the Capital One Arbitration Agreement states … Write your motions with that in hand and use the agreement the Plaintiff provided as you as an exhibit. Trust me if it is wrong the Plaintiff will provide the correct agreement. Stop fighting the little issues and focus on the JAMS complaint. PM Trueq as he has some awesome JAMS complaints.

Does that mean anything at all ? The second thing I want to pin down is if the lawyers do something illegal while they are acting on Cap1's behalf is Cap1 libel for the act the lawyers committed ?
I'm talking about Fraud Upon The Court ( submitting false evidence to the court that they knew or should have known was false )

In my request for ADMISSIONS I asked :

3 . Admit that Plaintiff submitted the falsified Verified Return Of Service to the Court in an act of Ambush on 7 / 23 / 2009 at the pretrial Hearing .



4 . Admit that Plaintiff was requested by Defendant to withdraw this false evidence .



They denied no# 3 ( if they submitted it without letting me see it that is considered Ambush correct? ) , and in No# 4 they admitted I requested but denied it was false .



So I guess I am going to have to place criminal charges against the Server before they are going to admit the evidence is false . I guess it is not enough with me giving them the proof that it was false evidence . ( we were not even in the State of Florida )



I think Trueq is correct , we are far better off in arbitration than in Court .
You keep running into trees. What is the ultimate outcome of a dismissal based on improper service? Does the case go away forever? Do you "win"?

Did contact and file a complaint with the Florida Attorney General's office regarding the service issue as was suggested?

Do not let minor technical stuff get in the way of the big picture. It appears the plaintiffs have given you what you want, arbitration. Like MG05 has said, focus on the JAMS complaint and process with regard to the cases that have stays.

Thanks , yes I am getting my JAMS forms ready now , I want to file one case then 2 or 3 weeks later another case till I have all 4 in Jams , but the Fraud thing I want to stay on because I will be going for personal lawsuits against the Summons Server company , The Server , and the Law Firm . should be fun . It could even give me 4 trips to Vegas with the arbitration . After being in the courts for 5 months I see why Trueq does what he does .

Cap1's agreements before 2005 must have been different because they sure don't want to give them to me .

Some courts are crooked. Sad some Lawyers as officers of the court are dishonest , unethical and very criminally Do not know the LAW. Even sadder that some Judges Do not know the Law.

That is the trend right now but it is changing and only because we are changing , it is like my dad always said " give them enough rope and they will hang themself .
In my cases Did they submit false evidence ? Yes Can I prove it ? Yes Did they do it in an act of Ambush ? Yes Can I prove it ? Yes Is the Judge allowing it ? Yes Is the Judge part of it ? If you look at the way our Hearing was held you have to say Yes

Unethical ? Yes Immoral ? Yes Are these JDB lawyers following their Oath ? NO
